1. Acceptance of Terms By accessing or using the Caller Technologies, Inc. (“Caller Technologies,” “we,” “us,” “our”) services, including our websites, platforms, VoIP phone system, AI-driven marketing automation tools, demographic data services, CRM integrations, and related features (collectively, the “Services”), you (“you,” “user,” or “customer”) agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must immediately cease using our Services.
2. Eligibility and Account Registration To use our Services, you must be at least 18 years of age. By registering an account or using our Services, you warrant that you meet this eligibility requirement. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
3. License and Use of Services Caller Technologies grants you a limited, non-exclusive, non-transferable license to access and use the Services in accordance with these Terms. You agree not to:
- Use the Services for illegal or unauthorized purposes.
- Reverse engineer, decompile, or otherwise attempt to discover the source code of our software.
- Share, sell, or distribute your access or data without explicit authorization from Caller Technologies.
4. Compliance with Telecommunications Laws Caller Technologies strictly adheres to telecommunications laws and regulations, including the Telephone Consumer Protection Act (TCPA) and the National Do Not Call Registry. You agree that you:
- Will not use our Services for sending unsolicited commercial communications (spam).
- Will ensure that all outbound communications comply with applicable federal, state, and local laws.
- Will regularly check and respect the National Do Not Call Registry, ensuring no calls or SMS texts are sent to numbers on this registry without explicit consent from the recipient.
Failure to comply may result in immediate suspension or termination of your account.
5. Data and Privacy Your use of the Services involves the collection, processing, and storage of demographic and personal data. Caller Technologies complies with all applicable privacy laws and regulations. Our Privacy Policy describes how we collect, use, and protect your information and is incorporated by reference into these Terms.
6. Intellectual Property All intellectual property rights related to the Services, including software, AI-driven analytics, demographic databases, marketing automation scripts, trademarks, and content are owned by Caller Technologies or its licensors. You acquire no ownership or intellectual property rights in our Services.
7. Limitation of Liability Caller Technologies will not be liable for indirect, incidental, consequential, or punitive damages arising out of or related to your use of our Services. Our total liability for claims arising under these Terms will be limited to the total amount you paid to Caller Technologies during the preceding twelve (12) months. Caller Technologies is not liable for the accuracy, completeness, or reliability of any data or demographic information provided by our Services.
8. Indemnification You agree to indemnify and hold Caller Technologies harmless from any claims, losses, liabilities, damages, and expenses (including attorneys’ fees) arising from or related to your use of the Services, violation of these Terms, or infringement of third-party rights.
9. Termination Caller Technologies reserves the right to terminate or suspend your access to the Services at any time, with or without notice, for conduct violating these Terms or detrimental to our interests or reputation.
10. Modifications to Terms Caller Technologies may revise these Terms from time to time. Any revisions will be posted on this page, and your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
11. Governing Law and Jurisdiction These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any legal action or dispute arising from these Terms or the Services shall be exclusively filed in the courts located in Los Angeles, California.
12. Entire Agreement These Terms constitute the entire agreement between you and Caller Technologies regarding the Services and supersede all prior agreements or understandings.
